US court orders new sentencing after AI-generated video of murder victim shown in court

An Arizona court has ruled that a man convicted of fatally shooting his neighbor must be resentenced after an AI-generated video of the victim was shown during sentencing. The court found the material was not based on the victim's actual recorded statements.

An Arizona court has ruled that 55-year-old Gabriel Paul Horcasitas must be resentenced for murder after an artificial intelligence-generated video of his victim was presented in court before his original sentencing.

Horcasitas was convicted of fatally shooting 37-year-old Christopher Pelkey in 2021 during a confrontation at a traffic light. He was initially sentenced to ten years in prison.

AI recreation of the victim spoke of forgiveness

Before sentencing, Pelkey's family presented the court with a video in which the slain man was digitally recreated using artificial intelligence. According to his sister, Stacey Wales, who previously spoke to the BBC, the family used recordings of his voice, video footage and photographs to build the digital version.

In the video, the AI-generated Pelkey addressed Horcasitas directly, expressing regret over the circumstances of their encounter and suggesting that in another life they might have been friends. He also spoke about his belief in forgiveness and in a forgiving God.

The presiding judge, Todd Lang, praised the video at the time, saying he detected genuine forgiveness in it despite understanding the family's justified anger.

Defense appealed the decision

Horcasitas's defense appealed the sentencing, arguing that such AI-generated material should not have been shown to the court before sentencing. On Wednesday, September 30, the court agreed with that argument.

The court emphasized that the video did not depict a real event and was not a recording of Pelkey's own thoughts expressed during his lifetime. The statements attributed to the victim were instead based on his sister's assumptions about what he might have said. As a result, Horcasitas must now be resentenced.

His attorney, Kristen Reller, who filed the appeal, declined to comment on the ruling, while Jessica Gattuso, an attorney representing the victim's interests, did not respond to a request for comment, according to the BBC.
