Google and Reddit Lose Court Battle Against Web Scraper; SerpApi Claims Partial Victory

A court dismissed Google's DMCA lawsuit against SerpApi, ruling that Google failed to show copyright ownership over search results. SerpApi defends open web access as Google plans to amend its complaint.

Google and Reddit have suffered a setback in their legal fight against web scraper SerpApi, which they accused of violating the Digital Millennium Copyright Act (DMCA). Last week, a court granted SerpApi's motion to dismiss Google's lawsuit, finding that Google lacked standing because it did not own the copyrighted content in search results and had not shown it was acting on behalf of rights holders.

Google had argued that SerpApi circumvented its anti-scraping technology and sold content from Google search results, including licensed material in knowledge panels. However, experts like Meredith Rose of Public Knowledge called the DMCA usage "bizarre" and not what the law intended. The court gave Google 21 days to amend its complaint, potentially focusing on licensed content in knowledge panels.

Reddit filed a similar lawsuit against SerpApi in October, but its case is still pending. SerpApi expressed confidence that Reddit's case will also be dismissed, as Reddit does not own the content users post. "Google and Reddit do not own the Internet," SerpApi stated, warning that their use of DMCA threatens the open web.

SerpApi's customers, including Nvidia, Uber, and Adobe, have faced uncertainty due to the litigation. The company maintains its business of providing structured access to search data is lawful. The ongoing cases could have broader implications for AI data scraping and access to public information.
