Manhattan prosecutors oppose Mangione's bid to have state charges dismissed

Manhattan prosecutors have filed papers rejecting Luigi Mangione's arguments for dropping the New York state murder case. He has already pleaded guilty to federal charges over the killing of UnitedHealthcare executive Brian Thompson.

Prosecutors in Manhattan filed court papers on Friday, 9 October, opposing Luigi Mangione's request to dismiss the New York state murder case against him. Mangione is accused of killing Brian Thompson, an executive at US health insurer UnitedHealthcare. The ruling on the request will determine whether he must also stand trial in state court, in addition to the federal case.

Background

Thompson was killed on 4 December 2024 outside a hotel in Midtown Manhattan. The shooting set off an intense manhunt and also prompted a wave of public anger at the practices of the for-profit US healthcare industry.

On 14 August, Mangione pleaded guilty in federal court to two stalking charges. That came weeks before the state murder and weapons trial, which had been scheduled for 8 September. Soon after the plea, his lawyers asked for the state case to be dismissed.

Judge Gregory Carro, who oversees the state case, postponed the proceedings and set the next court date for 10 December. He gave prosecutors until 9 October to respond and the defense until 30 October to reply.

The arguments

The defense says New York's double jeopardy law bars the Manhattan district attorney's office from prosecuting him. The statute says a person may not be prosecuted twice for the same offense, nor separately prosecuted for two offenses based on the same act or criminal transaction.

Prosecutors argue the murder case can go ahead under an exception to that law. They say the elements of the federal stalking charges and the state murder charge do not overlap in a way that would trigger double jeopardy protection.

Mangione has also claimed that prosecutors cannot pursue weapons charges because he previously faced federal weapons counts. Prosecutors note that the federal court dismissed those counts, and argue that dismissed federal charges do not amount to a separate prosecution. On the murder charge, they say the stalking offenses he admitted to are dramatically different from the state case.
