Labour Inspectorate explains how unpaid leave affects main vacation

The Labour Inspectorate warns that unpaid leave reduces the duration of paid main vacation because employment relations are suspended during that period and vacation does not accrue.

The Labour Inspectorate has announced that unpaid leave can affect the length of paid main vacation. Main paid vacation accrues over the entire calendar year – 365 days, or 366 in a leap year. Vacation accrues not only during actual work but also during main vacation, sick leave, study leave, and parental leave. However, in the case of unpaid leave, the situation is different: employment relations are suspended, and paid vacation does not accrue during this period. Consequently, the number of vacation days decreases proportionally to the time spent on unpaid leave. For example, if an employee takes two weeks of unpaid leave, the vacation is calculated for 351 days instead of 365. If the annual paid vacation is 28 calendar days, the employee will be entitled to approximately 26.9 days instead of 28. Thus, two weeks of unpaid leave reduce the main vacation by about one day.
