Ireland's Tax Appeals Commission, the independent body that hears disputes between taxpayers and the tax authority, has rejected a dairy farmer's appeal against a refused VAT refund. The farmer, who is in the flat-rate scheme for farmers, sought to recover €3,982.93 in VAT on an upgraded cluster flush system for milking equipment. The commission upheld the decision of the Revenue Commissioners, Ireland's tax authority, to refuse the refund.

How the dispute unfolded

The farmer first applied for the refund on November 10, 2025. The claim described the supply and installation of a cluster flush system in an extended farm shed and newly built slurry tanks.

Revenue rejected the claim because it was not related to the construction, extension, alteration or reconstruction of farm buildings or structures, land reclamation or fencing. The farmer resubmitted the claim several times in November 2025, and the refusal stood. A month later he resubmitted it again with an updated description of the work and supporting photographs. He also told Revenue that the milking machine was bought in 2022 and that the flush system was an addition to the milking parlour upgrade.

In its final decision of March 2, 2026, Revenue held that the system was an addition to a milking machine and not eligible for a VAT refund.

The commission's assessment

The farmer presented evidence to the commission that he had added a 16-unit automatic cluster flushing system to his existing milking machine in the milking parlour. He explained that this was done to ensure the well-being of his herd.

The Appeals Commissioner acknowledged this was a priority for the farmer. However, the commissioner said that although the installation is important to his dairy farming, it did not involve the construction or reconstruction of the building housing it. In the commissioner's view, it also did not involve an alteration of the dairy building.
