Prosecutor's Office Appeals Decision Allowing Crematorium Construction in Salgale Parish

The Prosecutor's Office has filed an appeal against the administrative court's decision that allowed the construction of a crematorium in Salgale parish, Jelgava municipality, citing insufficient transparency in the process.

The Prosecutor's Office has appealed the decision of the Administrative District Court that permitted the construction of a crematorium in Salgale parish, Jelgava region. The court had previously rejected the prosecutor's request to revoke the building permit.

In its ruling, the court found that the construction plan complies with the current territorial plan, which allows such structures in the area. The court also determined that there was no mandatory obligation to hold a public discussion before issuing the building permit.

Although a public discussion was organized after the permit was issued, the court noted that the public had the opportunity to express their opinions and that this procedural flaw was not considered significant. The court also found no significant environmental impact.

The court emphasized that subjective public attitudes toward specific types of buildings do not constitute a legal basis to deny construction if it meets regulatory requirements. Therefore, the court concluded that there were no violations of legal norms that would justify canceling the permit.

The Prosecutor's Office has now appealed this decision, and the case will be reviewed by a higher instance.
