Prosecutor's Office Appeals Court Decision Allowing Crematorium Construction in Salgale Parish

The prosecutor's office has appealed an administrative court ruling that permitted the construction of a crematorium in Salgale parish, Jelgava region, arguing that the building permit was issued improperly.

The prosecutor's office has filed an appeal against a decision by the Administrative District Court that allowed the construction of a crematorium in Salgale parish, Jelgava region. The court had previously rejected the prosecutor's request to revoke the building permit.

In its ruling, the court stated that the construction project complies with the current territorial plan, which permits such structures in the area. The court also found that there was no mandatory requirement to hold a public consultation before issuing the building permit. Moreover, it determined that the project would not have a significant environmental impact.

Although the public consultation was organized after the permit was issued, the court noted that the public had the opportunity to express their opinions, and the procedural flaw was not considered substantial. The court emphasized that the subjective attitude of the public toward a particular type of building is not a legal basis to deny construction if it meets regulatory requirements.

Given these findings, the court concluded that no legal violations justified revoking the building permit. Dissatisfied with this decision, the prosecutor's office has appealed to a higher instance.
