Court Does Not Revoke Building Permit for Crematorium in Jelgava Region

The Administrative District Court rejected the prosecutor's application to cancel the building permit for a crematorium in Salgale parish, ruling that the construction complies with the spatial plan and no significant violations were found.

The Administrative District Court has made a decision that allows the litigation over the construction of a crematorium in Salgale parish, Jelgava region, to continue. The court rejected the prosecutor's request to revoke the issued building permit. In its ruling, the court stated that the construction plan conforms to the current territorial planning, which allows such structures in that area.

The court found that a mandatory public consultation before the permit issuance was not required. Although the public consultation was organized after the permit was issued, the court considered that the public had the opportunity to express their opinions and that this procedural shortcoming was not significant. Additionally, the court did not identify circumstances indicating a significant impact on the environment.

The court emphasized that the subjective attitude of the public towards specific types of buildings does not, in itself, constitute a legal basis to prohibit construction if it meets regulatory requirements. After reviewing all case materials, the court concluded that no violations of legal norms were found that would justify revoking the building permit. Consequently, the legal proceedings on this matter will continue.
