In certain cases, heads of institutions may be transferred without open competition

The Saeima has adopted amendments to the State Civil Service Law, allowing in specific cases to transfer officials to head positions without an open competition, to ensure continuity.

The Saeima has approved amendments to the State Civil Service Law, which in certain cases allow civil servants to be transferred to head positions without an open competition. The changes aim to prevent situations where prolonged vacancies hinder the work of state administration.

Previously, when a head of an institution left office by mutual agreement, an open competition was mandatory. The new regulation allows the use of the transfer mechanism in such cases, if it is justified and in the state's interest. At the same time, the principle that open competition is the general rule for filling civil service positions remains in place.

The amendments also grant the Prime Minister the right to appoint the head of the State Chancellery without a competition. The explanatory note states that these changes are necessary to ensure prompt action and continuous performance of institutional functions. A prolonged vacancy in a leadership position can negatively affect decision-making and the operation of the institution.

The amendments were prepared by coalition deputies. Prime Minister Andris Kulbergs (AS) had previously expressed dissatisfaction with the current procedure, noting that lengthy competitions can hinder government work and effective management of institutions. However, he emphasized that he generally supports the principle of open competition. The amendments will take effect the day after their promulgation.
