Data State Inspectorate Launches Probe into Unsolicited SMS Offering Pork

Multiple residents have complained to the Data State Inspectorate about commercial SMS messages offering pork for purchase without prior consent. The inspectorate has initiated a preventive investigation.

The Data State Inspectorate (DVI) has received complaints from several residents regarding commercial text messages offering pork for sale. The DVI confirmed that it has launched an investigation into the matter.

The messages mention that pork can be purchased from a farm, but the specific farm is not named. The sender identifies itself as "Ozolu rukši". Currently, the DVI is conducting a preventive check to determine how the phone numbers were obtained and whether legal requirements for sending commercial communications were followed.

According to the Inspectorate, the Information Society Services Law stipulates that commercial messages to individuals via electronic communications may only be sent if the person has given free and unambiguous prior consent. Consent must be given by the individual themselves, not by a relative or friend. Additionally, commercial messages must include an option to opt out (e.g., by sending "STOP"), but this alone does not justify sending messages without prior consent.

Public records indicate that "Ozolu rukši" corresponds to the company SIA "SLX 22", registered in the Food and Veterinary Service register. According to "Firmas.lv", the company was registered in July 2024 with a share capital of 10 euros. The sole owner and officer is Ukrainian citizen Marats Vakarenko, while the proxy is Latvian citizen Andrejs Dučko.
